Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Services.

By accessing or using the Services, you agree to be bound by these Terms.

You must be at least eighteen (18) years of age to create an account or use the Services.

By using the Services, you represent and warrant that you are 18 years of age or older and legally capable of entering into a binding agreement.

We reserve the right to suspend or terminate accounts that violate these requirements.

The Services are intended solely for individuals and businesses located within the United States.

By using the Services, you represent that you are located in the United States at the time of registration.

Temporary access while traveling internationally does not constitute offering services to foreign residents.

We reserve the right to restrict or terminate access from jurisdictions outside the United States.

The Services provide digital tools for relationship reflection and communication, business management, family organization, travel planning, and event planning.

The Services are software tools only.

The Services do not provide legal advice, medical advice, mental health therapy, financial or tax advice, or licensed travel agency services.

All content, including AI-generated content, is provided for informational purposes only.

You are solely responsible for decisions made based on information provided through the Services.

Certain features utilize artificial intelligence technologies provided by OpenAI.

You acknowledge and agree that content you submit may be transmitted to OpenAI for processing.

AI-generated outputs may be inaccurate or incomplete and do not constitute professional advice.

You assume all risk associated with reliance on AI-generated outputs.

Users may optionally connect Google Calendar or Gmail to enable synchronization and user-directed email features.

By connecting a Google account, you authorize NestFlow to access and use Google data only for the permissions and purposes shown during Google consent and described in our Privacy Policy.

You are responsible for ensuring that calendars, messages, recipients, and content you choose to synchronize or send are lawful and appropriate.

You may disconnect Google services in NestFlow settings or revoke access through your Google Account permissions.

Your use of Google services remains subject to Google’s applicable terms and policies.

You are responsible for safeguarding your login credentials and for all activity under your account.

You agree to provide accurate information and keep it up to date.

All software, branding, content libraries, features, and underlying technology are owned by the Company and protected by intellectual property laws.

Except for the limited rights granted in these Terms, no rights are transferred to users.

You retain ownership of content you create or upload within the Services ("User Content").

You grant the Company a limited, non-exclusive license to host, store, reproduce, and display User Content solely to operate the Services.

We do not claim ownership of your User Content.

NestFlow accounts are controlled by a parent or guardian.

The account holder is responsible for managing child-related data and ensuring lawful authority over information entered.

The Services are not directed to minors.

Except where required by law, subscription fees are non-refundable.

Partial billing periods will not be prorated.

You may not use the Services for unlawful purposes.

You may not upload harmful, malicious, or fraudulent content.

You may not attempt to gain unauthorized access to the Services or interfere with system integrity or security.

We reserve the right to suspend accounts for violations.

We may suspend or terminate access for violations of these Terms, fraud, abuse, or non-payment.

Users may request account deletion at any time.

Certain records may be retained as required by law.

You agree to indemnify and hold harmless the Company from claims arising out of your use of the Services, your User Content, your violation of law, or your breach of these Terms.

Any dispute arising from these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in North Carolina.

You waive the right to trial by jury and the right to participate in class actions.

You may opt out of arbitration within thirty (30) days of account creation by written notice.

Claims eligible for small claims court may be brought in small claims court.

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

We may update these Terms from time to time.

Material changes will be posted with an updated effective date.

Continued use of the Services after changes constitutes acceptance of the revised Terms.
